In 2015, defendant Dezarae Fillmyer, who coached the Hightstown High School girls’ field hockey team, instructed players to warm up in an area adjacent to the school’s turf field, where the boys’ soccer team was practicing. Plaintiff Morgan Dennehy, a member of the field hockey team, was struck at the base of her skull by an errant soccer ball, allegedly causing the injuries of which she complained in a lawsuit she filed against Fillmyer, the school, and others. The trial court granted summary judgment in favor of defendants, holding that plaintiff was required to show defendants’ acts or omissions rose at least to the degree of recklessness described in Crawn v. Campo, 136 N.J. 494, 507-08 (1994), and Schick v. Ferolito, 167 N.J. 7, 18-20 (2001). The Appellate Division reversed, holding that a simple negligence standard applied. The New Jersey Supreme Court held the coach’s acts and omissions alleged here were governed by a simple negligence standard rather than the heightened standard of recklessness the trial court applied when one participant injures another during a recreational activity. Plaintiffs, the heirs and executor of the estate of Viviana Ruscitto, filed complaints seeking compensatory and punitive damages on numerous counts after Ruscitto’s death from leiomyosarcoma, a rare cancer that cannot be reliably diagnosed preoperatively, following the hysterectomy she underwent at defendant Valley Hospital with the use of a power morcellation device. Ruscitto sought treatment for uterine fibroids from defendant Howard Jones, a gynecologic surgeon at the hospital with whom Ruscitto met four times before she underwent surgery. Approximately six months before Ruscitto’s surgery, the FDA issued a Safety Communication discouraging the use of power morcellation. Valley Hospital administrators and Dr. Jones exchanged emails about the continued use of power morcellation. They considered factors including that “without the morcellator these cases would be open instead of laparoscopic, which “increases morbidity”; the fact that “the numbers at Valley” did not support the “1 sarcoma in 350 operations” number suggested by the FDA; and the role of informed consent. A “power morcellation group” was convened to draft an informed consent form. A form was prepared and approved by the legal department but was never implemented or used prior to Ruscitto’s surgery. One month after her surgery, the FDA issued an updated communication explicitly warning against the use of power morcellators in the majority of cases. Valley Hospital then discontinued use of the power morcellation device. Plaintiffs brought claims against several defendants, including Dr. Jones and the Valley Hospital administrators, and defendants sought partial summary judgment dismissing the punitive damages claim. The trial court denied the motions, and the Appellate Division denied leave to appeal. The New Jersey Supreme Court concluded a reasonable jury could not find by clear and convincing evidence that punitive damages were warranted based on the facts of this case, and partial summary should have been granted. Consolidated appeals arose from two actions based on real estate development disputes. Plaintiffs sued their former legal counsel, two real estate developers, and executives employed by the developers, alleging that defendants’ tortious conduct deprived them of the opportunity to construct an affordable housing complex on a property in Monroe Township, New Jersey; a second development was planned for Egg Harbor. Plaintiffs had formed NJ 322, LLC with a developer to build a market-rate rental and commercial development on the property. Plaintiffs contended that defendants arranged to have the property rezoned so that only affordable housing could be built on it, at which time the developer withdrew and Plaintiff had no alternative but to sell the property. Plaintiffs’ damages expert prepared a report that included his opinion on “the profits that would likely have been earned by [p]laintiffs in the event that their development goals and objectives in connection with the development of the Project had not been frustrated” by defendants’ alleged conduct. The expert presented lost profits damages models for the development: the profit plaintiffs would have achieved if the development had proceeded as originally planned, and the profit had plaintiffs been the ones to construct the affordable housing project that was actually built. Based on the new business rule, the trial court granted defendants’ motion to bar testimony by plaintiffs’ expert in both cases. The Appellate Division affirmed in both cases. The New Jersey Supreme Court rejected a per se ban on claims by new businesses for lost profits damages, and it declined to follow Weiss v. Revenue Building & Loan Association, 116 N.J.L. 208 (E. & A. 1936) to the extent that it barred any claim by a new business for such damages. "Claims for lost profits damages are governed by the standard of reasonable certainty and require a fact-sensitive analysis. Because it is substantially more difficult for a new business to establish lost profits damages with reasonable certainty, a trial court should carefully scrutinize a new business’s claim that a defendant’s tortious conduct or breach of contract prevented it from profiting from an enterprise in which it has no experience and should bar that claim unless it can be proven with reasonable certainty." East Bay Drywall, LLC was a drywall installation business that hired on a per-job basis. Once a builder accepts East Bay’s bid for a particular project, East Bay contacts workers -- whom it alleged to be subcontractors -- to see who is available. Workers are free to accept or decline East Bay’s offer of employment, and some workers have left mid-installation if they found a better job. In this appeal, the issue this case presented for the New Jersey Supreme Court was whether those workers were properly classified as employees or independent contractors under the Unemployment Compensation Law, which set forth a test -- commonly referred to as the “ABC test” -- to determine whether an individual serves as an employee. On June 30, 2013, East Bay, a business registered as an employer up to that point, ceased reporting wages to the Department of Labor and Workforce Development. Consequently, an auditor for the Department conducted a status audit that reviewed the workers East Bay hired between 2013 and 2016 to determine whether they were independent contractors, as defined by the ABC test. The auditor ultimately found that approximately half of the alleged subcontractors working for East Bay between 2013 and 2016 -- four individuals and twelve business entities -- should have been classified as employees. The Department informed East Bay that it owed $42,120.79 in unpaid unemployment and temporary disability contributions. The Supreme Court was satisfied that all sixteen workers in question were properly classified as employees, but it remanded the case back to the Department for calculation of the appropriate back-owed contributions. In June 2011, Thomasenia Fowler, as administrator of her husband Willis Edenfield’s estate, initiated a wrongful death/product liability action against Union Carbide, a manufacturer and supplier of asbestos that Edenfield handled as a daily part of his 40-year job at an adhesive manufacturing plant (the Bloomfield Plant). In 1968, Union Carbide began placing a warning on its asbestos bags. In compliance with an emergency standard imposed by OSHA, the company changed the warning in 1972. The change notwithstanding, an in-house staff-member of Union Carbide notified the company that its warning inadequately addressed the lethal dangers of asbestos exposure, but Union Carbide declined to upgrade its label. Union Carbide presented evidence that it periodically provided information and various safety warnings about its asbestos products to Edenfield’s employers and requested that the information and warnings be made available to the employees. The issue this case presented for the New Jersey Supreme Court’s review centered on whether a manufacturer or supplier that puts inadequate warnings on its asbestos products used in the workplace can fulfill its duty to warn by disseminating adequate information to the employer with the intention that such information will reach the workers using those products. The Court also considered whether, in charging on medical causation in this mesothelioma case, the trial court was required to give the frequency, regularity, and proximity language in Sholtis v. American Cyanamid Co., 238 N.J. Super. 8, 28-29 (App. Div. 1989), rather than the substantial factor test in the Model Civil Charge, as modified by the court. As to the duty to warn, the Court held that an asbestos manufacturer or supplier that places inadequate warnings on asbestos bags used in the workplace has breached its duty to the worker, regardless of whether it provides the employer with the correct information, which is reasonably intended to reach its employees. In 2013, the New Jersey Supreme Court affirmed the Appellate Division’s holding that Koger Distributed Solutions, Inc. (KDS) and Koger Professional Services, Inc. (KPS) had value as independent entities rather than being solely dependent on their parent company, Koger Inc. (Koger). The Court also held that Robert Sipko’s relinquishment of his 50 percent interests in KDS and KPS in 2006 was void for lack of consideration. The matter was remanded the trial court to determine what, if any, remedy was appropriate to compensate Robert for his interests in KDS and KPS -- companies that were rendered valueless by the time the matter reached the Supreme Court. In 2016, the trial court held that the appropriate remedy was a buyout of Robert’s interests in the companies given the court’s finding that George and Rastislav Sipko deliberately stripped the companies of value for the specific purpose of putting the money beyond Robert’s reach. The trial court accepted Robert’s expert’s valuation of the companies and found that KDS and KPS, at the time Robert filed the complaint in 2007, were worth approximately $1.5 million and $34.9 million, respectively. Accordingly, Robert’s 50 percent ownership in both companies totaled over $18 million, plus interest. On appeal, the Appellate Division agreed that a buyout was the appropriate remedy given the record. The court, however, remanded the matter for the trial court to determine whether a marketability discount should be applied. In light of all the defendants’ conduct regarding KDS and KPS to strip Robert of his rightful interests, “equity cannot abide imposing a marketability discount to the benefit of defendants.” The trial court’s acceptance of Robert’s expert’s valuation of the company fell within its broad discretion and was fully supported by the record. Defendants were given the opportunity to present an expert valuation of the companies on remand but made the strategic decision not to do so. Therefore, the Supreme Court declined to provide defendants with “another bite of this thoroughly chewed apple,” and reinstated the judgment of the trial court. View "Sipko v. In this appeal, the issue presented for the New Jersey Supreme Court in this case was whether a plaintiff had to submit an affidavit of merit (AOM) in support of a vicarious liability claim against a licensed health care facility based on the alleged negligent conduct of an employee who was not a “licensed person” under the AOM statute. Plaintiff Troy Haviland brought a claim against defendant Lourdes Medical Center of Burlington County, Inc., alleging, as relevant here, that an unnamed radiology technician employed by defendant negligently performed his radiological imaging examination, causing serious injuries. Defendant filed a motion to dismiss plaintiff’s complaint for failure to serve an AOM, which was granted. The Appellate Division reversed, determining that an AOM was not required when a plaintiff’s claim against a licensed person was limited solely to vicarious liability, based upon the alleged negligence of an employee who was not a licensed person under the AOM statute. To this the Supreme Court concurred: the AOM statute did not require submission of an AOM to support a vicarious liability claim against a licensed health care facility based only on the conduct of its non-licensed employee. Defendants Township of Sparta, Paul Austin, and Sparta Department of Public Works (collectively, defendants) challenged a denial of workers’ compensation benefits to plaintiff Diane Lapsley under the Workers’ Compensation Act. Lapsley was employed by the Township as a librarian for the Sparta Public Library. On February 3, 2014, Lapsley’s husband arrived at the library to drive Lapsley home. As they walked from the library to the car through the parking lot, they were suddenly struck by a snowplow owned by the Township and operated by Paul Austin, a Township employee. As a result, Lapsley suffered injuries to her leg requiring multiple surgeries and leaving her permanently disfigured. Lapsley filed a complaint against defendants in court, and later, a claim for workers’ compensation benefits against the Township in the Law Division of Workers’ Compensation. The Division found that Lapsley’s injuries arose out of and in the course of her employment and were therefore compensable under the Workers’ Compensation Act. Lapsley appealed, and the Appellate Division reversed, finding Lapsley’s injuries were not compensable under the Act. The New Jersey Supreme Court concluded Lapsley’s injuries arose out of and in the course of her employment because the parking lot where she was injured was owned and maintained by the Township, adjacent to her place of work, and used by Township employees to park. The Bergen County Improvement Authority (BCIA) issued a request for qualification (RFQ) for a redeveloper to act as general contractor in the rehabilitation of the Bergen County Courthouse. Nine companies, including plaintiff Dobco, Inc., submitted proposals in response to the RFQ. The BCIA notified four firms that they were selected to proceed, and it notified Dobco and the other firms not selected for the short list. Dobco and plaintiff Hossam Ibrahim, the vice president and a shareholder of Dobco, and a resident and taxpayer of Bergen County, immediately filed separate, but essentially identical, complaints alleging that defendants’ actions violated the Local Public Contracts Law (LPCL) and were arbitrary and capricious. The trial court dismissed plaintiffs’ complaints with prejudice for failure to state a claim, concluding that the project was “not subject to the LPCL because it has been designated a redevelopment project” under the Local Redevelopment and Housing Law (LRHL). The judge determined that plaintiffs were barred from seeking equitable relief because Dobco responded to the RFQ and Ibrahim had not challenged the procurement process or the RFQ prior to filing his complaint. The Appellate Division affirmed the dismissal of Dobco’s complaint, finding “that Dobco is estopped from now complaining that a process in which it willingly participated violated the law.” The Appellate Division, however, reversed as to Ibrahim, determining that he could proceed with his suit as a taxpayer and remanding to the trial court to enter an order permanently restraining the BCIA from proceeding with the procurement process contemplated by the RFQ. The New Jersey Supreme Court affirmed the Appellate Division substantially for the reasons expressed the appellate court's opinion. The Court required that, going forward, a plaintiff claiming taxpayer standing in an action challenging the process used to award a public contract for goods or services had to file a certification with the complaint. As to the merits of this appeal, the Court departed from the Appellate Division’s decision in only one respect: the Court did not rely on the leasing and financing arrangements contemplated by the BCIA and defendant County of Bergen. Plaintiff Hamid Harris alleged that Donald Stabile, a Newark Police Department detective, falsely accused him of four armed robberies that were committed in Newark in January 2015, and unlawfully arrested him in connection with those robberies based on an improperly issued arrest warrant. After the charges against plaintiff were dismissed, he filed this action. Defendants the City of Newark, Detective Donald Stabile, and Police Officer Angel Romero following the trial court’s denial of their motion for summary judgment, contended the trial court erred in denying them qualified immunity as a defense to Harris’s claims brought under the New Jersey Civil Rights Act (NJCRA). Defendants contended the trial court’s order denying summary judgment was a legal determination and should therefore be deemed appealable as of right, in keeping with both New Jersey appellate practice and federal law. The trial court reasoned that because Stabile did not have probable cause to arrest plaintiff, and because Stabile’s belief that plaintiff committed the robberies was objectively unreasonable, defendants were not entitled to qualified immunity. The Appellate Division ruled that “[t]he appeal is interlocutory as it is not from a final order” and dismissed defendants’ notice of appeal. The appellate court also denied defendants’ motion for leave to appeal. The New Jersey Supreme Court found the trial court’s order was a decision premised on factual findings as well as legal conclusions, not an exclusively legal determination. "In an NJCRA action, a defendant seeking to challenge a trial court’s order denying qualified immunity prior to final judgment must proceed by motion for leave to file an interlocutory appeal in accordance with Rules 2:2-4 and 2:5-6.
